Which statutes govern Alaska associations

Alaska's Uniform Common Interest Ownership Act (AS 34.08.010–34.08.995) governs condominiums and planned communities created on or after January 1, 1986. Certain provisions of the Act have been extended by amendment to reach older communities. It covers governance, meetings, elections, budgets, records, and assessment collection for both HOAs and condominium associations.

Alaska associations are also typically nonprofit corporations subject to the Alaska Nonprofit Corporation Act (AS 10.20), which provides member records rights and director standards of care for associations that operate as nonprofits. Meetings, budget ratification, and records

Unit owner meetings require notice under AS 34.08.338–34.08.340, and the board adopts budgets subject to ratification by the owners. If owners vote to reject a proposed budget, the prior year's budget is continued until a replacement is ratified.

The association must keep financial records sufficiently detailed to permit preparation of financial statements and make them reasonably available for examination by unit owners (AS 34.08.590). Records subject to inspection include meeting minutes, financial statements, contracts, and other association records, subject to specified exclusions such as litigation strategy and personnel matters.

Assessments, liens, and collections

Unpaid assessments, fees, charges, late charges, fines, and interest constitute a statutory lien on the unit under AS 34.08.470, arising from the time they fall due. The lien includes a limited priority portion over earlier security interests — often referred to as a superpriority — enforceable in the manner of other real-property liens after the required notices.

The association may recover costs of collection, including reasonable attorney's fees, as authorized by the governing documents and the Act. Collection procedures must comply with the statutory requirements, including notice to the unit owner before initiating foreclosure of the assessment lien.
